Membership Terms & Conditions for Pawar Fitness coaching: services, health disclosure, fees and payment, cancellations, conduct, and client responsibilities.

By registering for a trial, making payment, attending a session, joining a coaching group, accepting a plan, communicating confirmation through WhatsApp, email, message, call, form, or continuing to participate in any Pawar Fitness service, you confirm that you have read, understood, accepted, and agreed to these Terms & Conditions.
1. Nature of Services
- Pawar Fitness provides fitness coaching, strength training, conditioning, movement guidance, exercise programming, basic lifestyle guidance, habit-building support, accountability, and general nutrition education.
- The services may be delivered through one-to-one sessions, group sessions, online sessions, offline/in-person sessions, hybrid formats, recorded instructions, written plans, WhatsApp/email guidance, or any other format decided by the Coach.
- Coaching may include exercise demonstrations, form correction, progressive training plans, basic food-habit guidance, goal-setting, tracking, and accountability.
- Pawar Fitness is not a medical clinic, hospital, rehabilitation centre, physiotherapy centre, dietetic clinic, diagnostic facility, or emergency healthcare provider.
- The Coach does not diagnose, treat, cure, manage, or medically prescribe for any disease, injury, pain condition, hormonal condition, pregnancy-related condition, post-surgical condition, eating disorder, mental health condition, or chronic medical condition.
- Any nutrition guidance provided is general educational guidance and lifestyle support. It is not a medical diet prescription unless separately issued by a qualified medical professional.
2. Eligibility and Client Responsibility
- You confirm that you are voluntarily choosing to participate in coaching services provided by the Coach.
- You must be at least 18 years old to enroll independently. Clients below 18 years may participate only with written consent from a parent or legal guardian and at the sole discretion of the Coach.
- You are solely responsible for deciding whether you are medically, physically, mentally, and practically fit to participate in any exercise or nutrition program.
- You agree to consult a qualified medical practitioner before beginning or continuing training if you have, or suspect you may have, any medical condition, injury, pregnancy, recent surgery, chronic pain, cardiac condition, respiratory condition, metabolic condition, joint issue, neurological issue, blood pressure issue, diabetes, dizziness, fainting history, or any other health concern.
- You agree to follow the advice of your doctor or medical practitioner where medical advice is required.
- You understand that failure to disclose accurate health information may increase the risk of injury, medical complications, or unsafe exercise selection.
3. Health Disclosure and Medical Information
- Before starting training, and throughout your membership, you must honestly disclose all relevant health information requested by the Coach.
- This includes, but is not limited to: injuries, surgeries, pain, medications, pregnancy, postpartum status, medical diagnosis, doctor restrictions, allergies, fainting episodes, dizziness, breathlessness, chest pain, high or low blood pressure, diabetes, heart conditions, joint conditions, previous fractures, mobility limitations, eating disorders, and any other condition that may affect training.
- You must immediately inform the Coach of any change in your health, medication, pain level, injury, sleep, stress, pregnancy status, menstrual or hormonal concerns, medical advice, or lifestyle condition that may affect your ability to train safely.
- You must immediately stop exercising and inform the Coach if you experience pain, dizziness, nausea, chest discomfort, unusual breathlessness, faintness, blurred vision, severe fatigue, palpitations, numbness, tingling, swelling, injury, or any unusual symptom before, during, or after a session.
- The Coach may modify, pause, refuse, or discontinue your training if the Coach believes, at her sole discretion, that continuing may be unsafe or unsuitable.
- The Coach may request medical clearance before allowing participation or continuation. Refusal or delay in providing medical clearance may result in suspension of training without refund.
4. Assumption of Risk, Waiver, and Release
- You understand and accept that all exercise, physical training, strength training, conditioning, stretching, mobility work, bodyweight movement, resistance training, weight training, cardio activity, warm-up, cool-down, and nutrition/lifestyle changes involve inherent risks.
- Risks may include, but are not limited to: muscle soreness, fatigue, strain, sprain, joint pain, back pain, aggravation of an existing condition, dizziness, fall, equipment-related injury, fracture, fainting, dehydration, blood pressure fluctuation, medical episode, or other injury.
- You voluntarily assume full responsibility for all risks arising from your participation, whether supervised or unsupervised, online or offline, at home or at any training location, with or without equipment.
- You agree that you participate at your own risk and that you are responsible for following instructions, maintaining safe surroundings, using proper equipment, stopping when needed, and informing the Coach of any concern.
- To the fullest extent permitted by law, you release and discharge the Coach, Pawar Fitness, its representatives, assistants, contractors, affiliates, heirs, successors, and assigns from claims, demands, losses, liabilities, damages, costs, or expenses arising out of your participation in coaching services, except where liability cannot legally be excluded.
- This waiver and release applies to you and, where applicable, to your heirs, legal representatives, executors, administrators, successors, and assigns.
5. Emergency Authorization
- In the event of an apparent medical emergency, injury, or safety concern, you authorize the Coach to contact your emergency contact, family member, doctor, ambulance service, building/security staff, or any appropriate emergency support.
- The Coach may share relevant information necessary for emergency assistance.
- You understand that the Coach is not responsible for providing medical treatment, emergency diagnosis, transport, hospital admission, or medical decision-making.
- You remain responsible for all medical, ambulance, hospital, consultation, transport, or emergency costs incurred.
6. Free Trial and Onboarding
- Pawar Fitness may offer a free trial, introductory call, assessment, or consultation at the discretion of the Coach.
- A free trial does not guarantee admission into a paid plan, continuation of coaching, fixed pricing, or availability of a slot.
- After the trial or onboarding discussion, the Coach may recommend a suitable plan based on goals, schedule, readiness, group availability, training level, and safety considerations.
- The Coach reserves the right to decline enrollment if the Client’s expectations, conduct, availability, health condition, payment reliability, or training requirements do not align with the service.
7. Membership Plans, Fees, and Payment
- Pawar Fitness may offer monthly, quarterly, half-yearly, yearly, personal, group, online, offline, hybrid, or custom coaching plans.
- All fees, plan duration, inclusions, exclusions, frequency, session format, and pricing must be confirmed by the Coach before enrollment.
- Fees are payable in advance unless the Coach expressly agrees otherwise in writing.
- Training will begin only after payment is received and confirmed.
- Payments are non-refundable, whether fully or partially used, unused, missed, paused, discontinued, or terminated by the Client, unless the Coach expressly agrees in writing.
- A coaching plan is not a pay-per-attendance arrangement unless specifically stated in writing. Fees are charged for reservation of coaching access, planning, availability, programming, group viability, administration, and the Coach’s time commitment.
- Fees are subject to change at the Coach’s discretion. Revised fees may apply to renewals, new plans, changed formats, smaller groups, altered schedules, or any modified arrangement.
- Any bank charges, payment gateway charges, transfer charges, taxes, or other applicable deductions are the responsibility of the Client unless stated otherwise.
- Failure to pay on or before the due date may result in suspension of access, removal from a group, loss of slot, cancellation of plan, or revised pricing.
8. Group Coaching, Retainer Fee, and Minimum Group Viability

Group coaching fees are offered on the basis of group size, schedule, collective commitment, and the Coach’s minimum operating threshold.

Where a discounted group rate is offered, the fee is not merely a per-session attendance fee. It functions as a monthly retainer to reserve your spot, maintain the group structure, and ensure that the group can continue at the agreed rate.

For example, where a group of four members is offered a specially discounted rate such as ₹4,000 per person per month, that rate depends on all four members maintaining active payment for that month.

If one member chooses not to pay, pauses, exits, or remains absent without retaining the membership, the group may fall below the minimum rate required for the Coach to run the sessions.

In such a case, the Coach may, at her discretion:
- increase the per-person fee for the remaining members;
- ask the absent member to pay the retainer to keep the spot active;
- reorganize the group;
- merge the group with another group;
- change the schedule, format, or frequency;
- pause or discontinue the group; or
- offer the Client a different plan at a different rate.

If you know in advance that travel, work, family commitments, events, illness, exams, or any other reason will prevent you from attending, you may still be required to pay the monthly retainer if you wish to keep your spot active and protect the group rate.

If you choose not to pay the retainer for a month, your membership and spot may be treated as inactive, and re-entry will be subject to availability, Coach approval, current pricing, group consent where relevant, and operational feasibility.

The Coach is not obligated to absorb the financial shortfall created by a member’s non-payment, absence, pause, or withdrawal.

If a member’s non-payment affects the group rate, the Coach may communicate the necessary price adjustment to the remaining group members in a professional and limited manner.

The Coach is not responsible for disagreements between group members regarding contribution, affordability, attendance, or continuation.

Missed group sessions are not automatically refundable, transferable, adjustable, or carried forward.

Group members must respect the common schedule. Individual convenience cannot override group viability unless the Coach agrees in writing.
9. Non-Transferability and No Membership Sharing
- Every membership, package, subscription, session, group slot, trial, offer, discount, and plan is personal to the enrolled Client only.
- Memberships are strictly non-transferable.
- You may not transfer, assign, sell, gift, lend, exchange, split, share, or allocate your membership, slot, package, discount, session, login, plan, or group access to any other person.
- A single membership cannot be used by a spouse, sibling, parent, child, relative, friend, colleague, guest, neighbor, or any other person.
- You cannot train an entire family or multiple individuals under one membership by dividing days, alternating attendance, rotating family members, sharing sessions, or substituting another person in your place.
- Each person who wants coaching must complete their own onboarding, disclose their own health information, receive Coach approval, and pay for their own membership or package.
- Attendance by an unauthorized person, substitute, family member, or guest may result in immediate termination of membership without refund.
- The Coach may refuse to train any person who is not the registered paying Client.
10. Session Duration, Attendance, and Punctuality
- Standard training sessions are scheduled for approximately 60 minutes unless otherwise agreed.
- Clients are expected to be ready on time, dressed appropriately, hydrated, and prepared with required equipment, space, camera setup, internet connection, and any other training requirements.
- If you arrive late, the session will still end at the originally scheduled end time.
- The Coach may allow a grace period of up to 15 minutes. After 15 minutes, the session may be treated as a no-show and forfeited.
- Late arrival does not entitle you to extra time, refund, partial refund, carry-forward, or replacement session.
- If the Coach is delayed due to unavoidable circumstances, the Coach may extend the session, reschedule, or provide an appropriate adjustment at her discretion.
11. Cancellation, Rescheduling, and Missed Sessions
- To cancel or reschedule a session, you must provide at least 24 hours’ prior notice.
- If less than 24 hours’ notice is given, the session may be treated as forfeited and counted as completed.
- No-shows are treated as used sessions.
- Rescheduling is subject to the Coach’s availability and is not guaranteed.
- Any permitted rescheduled session must be completed within the extension window approved by the Coach. Unless otherwise agreed, the maximum extension for a rescheduled session is 7 days.
- Unless otherwise agreed in writing, a maximum of two reschedule requests may be accepted in a month.
- Repeated cancellations, delays, rescheduling requests, or attendance issues may result in refusal of future rescheduling, change of plan, removal from group coaching, or termination of membership without refund.
- Missed sessions due to travel, work, family functions, social commitments, personal inconvenience, network problems, power cuts, unavailability, oversleeping, forgetfulness, or non-emergency reasons are the Client’s responsibility.
- The Coach may, at her sole discretion, make compassionate exceptions in genuine emergencies, but such exceptions do not create any future right, precedent, or obligation.
12. Pause, Freeze, Extension, and Carry-Forward
- Memberships are for the stated duration and do not automatically pause, freeze, extend, or carry forward due to non-attendance.
- Any pause, freeze, extension, or carry-forward must be approved by the Coach in writing before the absence period begins.
- Approval is discretionary and may depend on the plan type, group format, reason for absence, medical documentation, schedule feasibility, and payment status.
- Group memberships generally cannot be paused without affecting the group rate and minimum viability.
- If you want to retain your group slot during absence, you may be required to pay the retainer or full monthly fee.
- Unused sessions or missed days do not automatically convert into credit, refund, replacement sessions, personal sessions, family sessions, or extended membership days.
- Expired memberships, expired packages, and unused sessions are not redeemable unless the Coach expressly confirms otherwise in writing.
13. Coach Cancellations and Service Adjustments
- If the Coach cancels a session due to emergency, illness, travel, unavoidable scheduling issue, technical issue, or operational reason, the Coach may provide a replacement session, adjusted session, credit, or revised schedule at her discretion.
- The Coach may change session timing, batch structure, group format, platform, training style, frequency, or delivery method where reasonably required.
- The Coach may temporarily pause services due to illness, emergency, force majeure, travel, personal reasons, or circumstances beyond control. Reasonable adjustments may be offered where feasible.
- Such changes do not automatically entitle the Client to refund unless specifically agreed by the Coach.
14. Online and Home Training Requirements
- If sessions are conducted online or at home, you are responsible for ensuring a safe training environment.
- You must arrange adequate space, stable flooring, lighting, ventilation, internet connection, camera placement, device charging, and safe equipment.
- You must keep children, pets, sharp objects, slippery surfaces, unstable furniture, and other hazards away from the training area.
- You must inspect your equipment before use and ensure that weights, bands, mats, shoes, benches, chairs, steps, and other items are safe and appropriate.
- The Coach is not responsible for injuries, accidents, interruptions, or losses caused by unsafe surroundings, defective equipment, poor connectivity, distractions, or failure to follow instructions.
- Online form correction is limited by camera angle, video quality, internet stability, lighting, and Client responsiveness.
15. Nutrition Guidance, Supplements, and Food Responsibility
- Any food, nutrition, hydration, lifestyle, or habit guidance provided is general coaching support and educational in nature.
- The Coach does not prescribe medical diets, clinical nutrition therapy, medicines, supplements, hormones, fat burners, detoxes, or disease-specific treatment.
- You must consult a qualified doctor, registered dietitian, or relevant healthcare professional before making dietary changes if you have any medical condition, pregnancy, breastfeeding status, eating disorder, allergy, digestive issue, kidney/liver condition, diabetes, thyroid issue, cardiac condition, or other special requirement.
- You are responsible for checking food allergies, religious preferences, cultural preferences, ingredients, intolerances, affordability, suitability, and medical restrictions.
- The Coach is not responsible for adverse reactions, allergies, digestive discomfort, medical complications, or outcomes caused by your food choices, supplement choices, under-eating, over-eating, non-disclosure, or failure to follow medical advice.
16. No Guarantee of Results
- Fitness outcomes vary from person to person.
- The Coach does not guarantee weight loss, fat loss, inch loss, muscle gain, strength gain, posture correction, pain relief, disease improvement, body transformation, competition success, or any specific result within any time period.
- Progress depends on many factors including consistency, sleep, stress, food habits, medical conditions, hormones, lifestyle, age, genetics, effort, recovery, attendance, and honesty in reporting.
- Testimonials, photos, examples, or previous client outcomes do not guarantee that you will achieve the same result.
- You agree that lack of expected results is not a valid ground for refund.
17. Client Conduct and Safety
- You agree to behave respectfully with the Coach and other group members.
- Abuse, harassment, intimidation, insults, inappropriate comments, discrimination, stalking, threats, repeated arguments, disruptive conduct, or disrespectful communication will not be tolerated.
- You must not attend sessions under the influence of alcohol, recreational drugs, sedatives, or any substance that may impair judgment, coordination, or safety.
- You must not pressure the Coach to provide medical advice, guaranteed results, unsafe progressions, unrealistic targets, crash diets, or excessive training.
- You must not share another member’s personal information, videos, photos, health information, progress details, or messages outside the group.
- The Coach may immediately suspend or terminate services without refund if your conduct is unsafe, disrespectful, dishonest, disruptive, non-compliant, or harmful to the Coach, other clients, or the group environment.
18. Intellectual Property and Use of Coaching Material
- All exercise plans, messages, videos, notes, nutrition guidance, trackers, templates, PDFs, worksheets, demonstrations, schedules, progress formats, and coaching material provided by the Coach remain the intellectual property of the Coach or Pawar Fitness.
- Coaching material is provided for your personal use only.
- You must not copy, forward, sell, publish, upload, record, distribute, modify, teach, reproduce, or commercially exploit any coaching material without written permission from the Coach.
- You must not record sessions, take screenshots, screen-record, or circulate group content without the Coach’s prior written consent.
- Violation of this clause may result in immediate termination without refund and may lead to legal action where appropriate.
19. Photos, Videos, Testimonials, and Progress Sharing
- The Coach may ask for photos, videos, measurements, progress updates, or testimonials for coaching, form correction, progress tracking, or promotional use.
- You are not required to provide promotional consent unless you voluntarily agree.
- The Coach will not intentionally publish your identifiable photo, video, testimonial, or personal transformation details for marketing without your consent.
- You agree not to misuse, copy, share, or publish photos, videos, messages, or personal details of the Coach or other clients without consent.
- Form-check videos and progress photos may be used internally by the Coach for coaching and tracking purposes.
20. Privacy and Communication
- The Coach may collect and use your name, phone number, email address, age, gender where relevant, health disclosures, fitness goals, lifestyle information, attendance details, payment status, progress updates, photos, videos, measurements, and communication history for coaching and administration.
- Communication may take place through WhatsApp, phone, email, website forms, video calls, payment platforms, or other digital tools.
- While the Coach will make reasonable efforts to maintain confidentiality, you understand that digital communication platforms are third-party services and may carry their own privacy and security risks.
- In group coaching, limited information such as name, attendance, schedule, group fee implications, or necessary coordination details may be visible or communicated to group members.
- You must not share confidential group discussions, another client’s health details, or personal information outside the group.
- You are responsible for ensuring that the information you provide is accurate, current, and complete.
21. Communication Boundaries and Response Time
- Coaching support outside scheduled sessions may be provided at the Coach’s discretion and within reasonable working hours.
- The Coach is not required to provide instant replies, emergency responses, late-night support, daily unlimited messaging, or medical crisis support.
- WhatsApp or message support, where offered, is for coaching-related clarification and accountability only.
- Excessive messaging, repeated urgent demands, disrespectful follow-ups, or non-coaching requests may be restricted.
- For medical emergencies, you must contact emergency medical services or a qualified healthcare provider, not the Coach.
22. Termination, Suspension, and Refusal of Service
The Coach may suspend, terminate, refuse, or discontinue services immediately, with or without refund depending on the circumstances, if:
- payment is delayed, incomplete, reversed, disputed, or unpaid;
- health information is withheld, misrepresented, or not updated;
- medical clearance is required but not provided;
- the Client repeatedly misses, cancels, delays, or disrupts sessions;
- the Client shares, transfers, or misuses membership;
- another person attempts to train under the Client’s membership;
- the Client behaves disrespectfully, abusively, dishonestly, or unsafely;
- the Coach believes continued training is unsafe or unsuitable;
- the Client violates these Terms & Conditions; or
- continuation is not practically, medically, professionally, or operationally viable.
23. Limitation of Liability and Indemnity
- To the fullest extent permitted by law, the Coach and Pawar Fitness shall not be liable for indirect, incidental, special, consequential, punitive, remote, or exemplary damages.
- The Coach shall not be liable for loss, injury, damage, delay, non-performance, medical complication, or dissatisfaction arising from your participation, non-disclosure, non-compliance, unsafe surroundings, defective equipment, missed sessions, lack of results, group changes, schedule changes, or personal circumstances.
- You agree to indemnify and hold harmless the Coach and Pawar Fitness from any claims, losses, liabilities, damages, costs, or expenses arising from your breach of these Terms, non-disclosure of health information, misuse of services, unsafe conduct, unauthorized sharing, or participation by any unauthorized person under your membership.
- Nothing in these Terms is intended to exclude liability that cannot legally be excluded.
24. Force Majeure
- The Coach shall not be liable for delay, interruption, cancellation, or inability to provide services due to circumstances beyond reasonable control.
- Such circumstances may include illness, injury, accident, family emergency, internet failure, power failure, platform outage, natural disaster, epidemic, government restriction, travel disruption, building restriction, public disturbance, or any other event beyond control.
- The Coach may offer reasonable alternatives where feasible, but refunds are not automatic.
25. Offers, Discounts, and Special Pricing
- Discounts, group rates, promotional rates, trial offers, special arrangements, or goodwill exceptions are discretionary.
- Any exception granted to one Client does not create a right for the same exception to be granted to another Client.
- A discounted rate may be withdrawn or revised if group size, schedule, plan duration, attendance pattern, payment reliability, or service format changes.
- The Coach may correct pricing errors, revise plan structures, or discontinue offers at her discretion.
26. Governing Law and Dispute Resolution
- These Terms shall be governed by the laws of India.
- In case of any concern, the Client agrees to first raise the matter directly with the Coach in good faith for informal resolution.
- If the matter cannot be resolved informally, the parties may pursue remedies available under applicable Indian law.
- Subject to applicable law, disputes shall fall under the jurisdiction of competent courts at Pune, Maharashtra, India, unless otherwise required by law.
27. Updates to Terms
- Pawar Fitness may update, revise, or modify these Terms & Conditions from time to time.
- Updated Terms may be posted on the website, shared through message, email, form, invoice, or communicated before renewal.
- Continued participation, renewal, payment, or attendance after updated Terms are communicated will be treated as acceptance of the updated Terms.
28. Client Acknowledgement
By enrolling, paying, attending, or continuing with Pawar Fitness coaching, you acknowledge and confirm that:
- You have read and understood these Terms & Conditions.
- You voluntarily participate in the coaching program.
- You understand the risks associated with exercise and fitness training.
- You have disclosed all relevant health information honestly.
- You will consult a medical practitioner where required.
- You understand that fees are generally paid in advance and are non-refundable.
- You understand that group fees may operate as retainers to preserve your spot and group viability.
- You understand that membership is strictly non-transferable and cannot be shared with family members or any other person.
- You understand that missed sessions, late arrivals, no-shows, and personal unavailability may result in forfeiture.
- You agree to follow the Coach’s instructions, safety guidelines, communication boundaries, and professional conduct expectations.
